Fire protection obligations: an overview for employers

Fire protection is mandatory for every company, and the statutory body is responsible for it. Here is an overview of the obligations under Act No. 314/2001 Coll. and Decree No. 121/2002 Coll. – what you must have, how often, and what you risk during an inspection.

Who must meet fire protection obligations

Every legal entity and self-employed person has obligations, and the statutory body is responsible for meeting them (Section 6 of Act No. 314/2001 Coll.). The company must carry out the tasks through a certified fire protection technician – in-house or external.

Only the smallest businesses are exempt: no more than 5 employees on the premises, activity only in a flat, a kiosk or a space of up to 100 m², and no activities with an increased fire risk. These only need to provide employee training (Section 7 of the Act).

Inspections: every 3 months in ordinary premises, 6 months for administrative premises, 12 months for occasionally used workplaces and residential buildings.

Fire protection documentation

Every company needs a fire identification card, fire alarm guidelines, a fire log book and records of employee training (Section 24 of Decree No. 121/2002 Coll.). Depending on the operation, you may also need:

  • workplace fire regulations – for places with an increased fire risk,
  • a fire evacuation plan – if the building does not have simple evacuation conditions,
  • records of fire patrol training,
  • records of fire equipment inspections and other documents.

The documentation is approved by the statutory body, kept in writing and reviewed after every change, and at least once every 12 months.

Activities and places with an increased fire risk

Slovak regulations distinguish activities, places and times with an increased fire risk. Typical activities are welding and working with flammable substances or open flames; typical places include stores of flammable liquids and gases. The company identifies and marks these places through its fire protection technician, and stricter measures apply to them, including workplace fire regulations.

Fines for breaches

The state fire inspectorate can impose a fine of up to €8,298, for example for missing inspections, training or documentation. More serious breaches, such as blocked escape routes or uninspected fire equipment, can lead to a fine of up to €16,596. For a repeat breach within three years, the fine can be up to double (Section 59 of Act No. 314/2001 Coll.).

Frequently asked questions about fire protection obligations

Does a small company also need fire protection in place?

Yes, every legal entity and self-employed person has obligations under Act No. 314/2001 Coll. The smallest businesses with no more than 5 employees on the premises that operate only in a flat, a kiosk or a space of up to 100 m² and have no activities with an increased fire risk only need to provide employee training (Section 7 of the Act).

How often are preventive fire inspections carried out?

Every 3 months in ordinary premises such as a shop, production facility, warehouse or car service, every 6 months in buildings used only for administrative work and every 12 months in residential buildings and buildings with occasionally used workplaces (Section 14 of Decree No. 121/2002 Coll.).

Must every employee be trained, including people on agreements?

Yes. Fire protection training applies to all employees, including people on agreements and temporary workers. New employees are trained before they start work, and the training is repeated every 24 months (Sections 20 to 22 of Decree No. 121/2002 Coll.).

Who carries out preventive fire inspections?

A fire protection technician or fire protection specialist with a valid certificate (Section 9 of Act No. 314/2001 Coll.). The result of the inspection is recorded in the fire log book.

When do we need a fire evacuation plan?

If the building does not have simple evacuation conditions, i.e. if it has more than two above-ground floors, an underground floor with workplaces, or is used by people who do not know the building (Section 28 of Decree No. 121/2002 Coll.).

How many fire extinguishers must we have?

The regulation does not set a fixed number. The number and type of fire extinguishers are determined according to the technical standard STN 92 0202-1 (Section 89 of Decree No. 94/2004 Coll.), most often in the fire safety design of the building. Who inspects fire protection and what are the fines?

State fire supervision is carried out by the regional or district directorate of the Fire and Rescue Service. The fine can be up to €8,298, up to €16,596 for more serious breaches and up to double for a repeat breach within three years (Section 59 of Act No. 314/2001 Coll.).
